1. Desarrollo del Territorio y Sociedad del Conocimiento Ltd. (hereinafter DTySC), established on December 28, 2002, with registered office in Madrid, Calle Serrano 107 (28006) with VAT number B-83453373, as owner of this website with the registered domain name www.wisdem.org and responsible for all automatic index files derived from this page, guarantees the integrity and full compliance with its obligations under the Spanish Data Protection Act 15/1999 of December 13th (L.O.P.D.), and the 1720/2007 Royal Decree of December 21th, through which the L.O.P.D was passed, (hereinafter LOPD and RLOPD) and other applicable regulations.

2. This statement is intended to inform users of the data protection policy implemented by DTySC. This policy shall be applicable if and when users are required to complete online forms where personal data is collected by DTySC, as are the specific Privacy clauses applicable to each form.

3. DTySC reserves the right to modify this Privacy Policy according to self-regulatory or legislative requirements, therefore users are advised to consult this information regularly.

4. DTySC is fully aware of the use and treatment that must be given to the personal data required or obtained from users of this webpage, in order to manage the services offered or to provide users with information regarding commercial products or services that may be of interest.

5. DTySC will hereby adopt the necessary technical and organizational measures to guarantee the security of data of personal nature and avoid its alteration, loss, treatment or unauthorized access, taking in to consideration the state of technology in accordance with the RLOPD provisions. However, DTySC cannot guarantee the absolute infallibility of the Internet and therefore any violation of data through fraudulent means by third parties.

6. Some of the services that DTySC offers its users use cookies. A cookie is as small text file that a server can save on the hard drive of a computer to store a piece of information about the user. The cookie can only be read by the website that sent it to the computer. It is not an executable file nor can it propagate itself or contain a virus. DTySC uses this data with aim to improving the quality of its services. The information that DTySC can store through this mechanism allows the registered user to be recognised on his or her visits to the. The user can configure the browser to accept or reject cookies, however DTySC recommends that users accept the use of cookies in order to improve and adapt content to user preferences, by allowing the collection of more precise data. DTySC will not be held responsible if by deactivating cookies the user experiences less than optimal functionality.

7. Users will respond, in any case, to the veracity of the data provided and are responsible for notifying DTYSC of any modification to this data, deeming DTYSC exempt from any kind of responsibility.

8. Users are aware of their rights and may exercise the right to access, cancelation, rectification and opposition, through written notification to the addresses indicated in each case or to the address: legal@wisdem.org identifying themselves and specifying their request.

9. DTYSC by virtue of the Law 34/2002, July 11, Information Society and ecommerce services, that under no circumstance will DTYSC send publicity and communications with commercial purposes or any other nature to users without their previous request and consent. Likewise, DTYSC will not send unsolicited messages that have not been requested or previously consented, nor will send it unsolicited electronic chain mail.

10. DTySC hereby informs users that should they subscribe to commercial mailing lists or alerts, they may unsubscribe from these communications by following the instructions indicated or by writing to legal@wisdem.org.

By developing the wisdem web project DTySC aims to establish a global network in which people affected by dementia, their families, carers and professionals can share their experiences, methods and practices with others anywhere in the world, creating a meeting place in which to share information on non-pharmacological methods and practices.

To this end, it is essential that a comprehensive series of guidelines be established that foster proper and legal use of the website www.wisdem.org and that clearly express that full compliance of these rules and current legislation is the sole responsibility of those who access and use the site.

The use of the www.wisdem.org website implies the users knowledge and full acceptance without reservation of the conditions here stated.

Access

Access to the web is only permitted for persons over the age of 18

Forgery or attempted forgery by third parties is prohibited.

The provision, be it direct or indirect, of personal data or information protected by Spanish legislation is prohibited.

The use of www.wisdem.org shall always be in agreement with the terms here stated and with fully respect for the law, public order and decency, and a special consideration and respect for the protection of young children.

The views expressed in the community sections of the site are entirely those of the authors and in no way represent the opinions of wisdem. As is any disclosed information corresponds exclusively to the person who facilitated.

Under no circumstances may the site be used with the intention to perform or carry out illicit acts, prohibited under current legislation, and/or impair the rights or property of any nature belonging to DTySC or third parties.

A correct usage of the portal is one that respects the conditions and characteristics defined such as format, source, extension, animations, etc. so as to avoid functionality problems and ensure an optimal user experience.

Community based sections on the wisdem web platform: limitations and prohibitions

All expressions of opinions and personal views will be moderated. The moderation team may initiate dialogue and foster user participation, and may, if necessary, summarize the interventions and publish the conclusions reached. The moderation team will act to enforce the present terms of use at all times.

Any content deemed to be false, inaccurate, not exhaustive, partial or not current and /or  property rights of third parties and illegal information, unreliable that are published in the community based areas of the portal are the sole responsibility of the user.

DTySC is not responsible for any opinion, comment, view etc. published - directly or indirectly - by the users in the community based sections of the website. The author or the person disseminating this information is solely responsible.

DTySC is not be liable for the damage or harm caused, directly or indirectly, by user generated content to third parties, the hosting, transfer and access to information and content.
 

The following are not permitted:

a) Insulting comments or views; content that goes against legal, moral and public order as well as those that may be considered: discriminatory or threatening to the dignity of the individual; sexist; xenophobic; libellous; obscene; insulting; that affect the appearance or disabilities of persons; and offensive to minority groups.

b) Content or messages that contain or incite violence or the carrying out of criminal or civil wrongdoing.

c) Views that are bogus, ambiguous, inaccurate, exaggerated, misplaced and /or may cause confusion about its purpose or intent of the individual.

d) Views that undermine or discredit the credibility of DTySC, and any of its members, employees or third parties.

Commercial advertising is strictly prohibited.

The use of elements that may cause the transmission of computer generated viruses or any element that may cause damage, in whole or in part, or cause abnormal functionalities in DTySC’s computer equipment and that of third parties, including both hardware and software as well as files stored in the computers listed. In no event shall DTySC be held responsible for the presence of viruses or other elements of content that may affect their computer systems or archived documents.

“Copyright" and other identifying data regarding the reservation of rights or of the proprietors will not be ignored or infringed.

The publication of photos or images of minors or of third parties without their consent, nor any other piece of content, whatever its form (written, visual, audio, etc..) whose intellectual property corresponds to a third party.

Neither spamming nor links to websites unrelated to the aims of wisdem will be permitted. 

DTySC

DTySC assumes no obligation to monitor the use that third parties make of the community based sections of the platform, nor that of the content and information stored and published in these sections. Nevertheless, DTySC does reserve the right to delete, remove or not to publish such views.

Similarly, DTySC remains exempt from: any responsibility for the use that third parties make of the web page content; user generated content; to verify the identity of the users as well as the authenticity of the data they provide about themselves and/or third parties.

DTySC will fully collaborate with agencies and authorities when instructed to suspend the service; as soon as DTySC is informed of illicit activity or content on the site it adheres to remove such content; deeming itself exempt of any responsibility for the acts or illegal content or interruption of the provision of the portal or any part thereof.

Notwithstanding the aforementioned, DTySC reserves the right to review and delete, without prior notification nor explanation, any information or opinion that is published on the page.

This right may be exercised a priori with the aim to prevent the circularion a posteriori, by eliminating any view, information, link etc. which have received substantiated complaints; which contain or support issues or positions are not permitted by law or the terms of use of the site; which include advertising; which impede the correct functioning of the web, etc.

DTySC is not responsible for any information that can be accessed via links or referrals through its website. In the event that users become aware of a piece of content that violates the rights of third parties or the current legislation, they can request the removal of such links and/or referrals via the Your Voice section provided by DTySC.

DTySC reserves the right to delete this website at any time and without prior notice.

The works and content distributed on this site are protected by Creative Commons licenses. This does not mean they are not copyright protected. This type of licenses offer rights to third parties under certain conditions. The Creative Commons license is applied to the content created by DTySC and its collaborators for the wisdem web project. All content (text, images, logos, etc.) that is not the property of DTySC or its collaborators remains exempt from said license, in which case authorisation must be requested in order to reproduce the works.
